Statement of the participant (driver, co-driver, service and accompanying persons) regarding the waiver of liability
The participants take part in the event at their own risk. They alone bear the civil and penal responsibility for all the damages caused by them or the vehicle they’re operating, in as far as no waiver of liability was agreed upon according to the Regulations, the General Terms of Conditions, this announcement.
They assure, that the vehicle conforms to the technical provisions within the Regulations in all points, and that they will only operate it during the event in technically and optically perfect condition.
By handing in the registration or this waiver of liability statement, the participant waives all claims of any kind for damages, which occur in connection with the event, namely against:
A) the organizer Offroad Solutions Ltd., the company Schalber Event GmbH, the company Rebel Media GmbH, the company Rebel Marketing GmbH, the company Rebel Productions GmbH, the company Good Guy Marketing GmbH, all of their officers, managers, and their employees, track guards and marshals, as well as property owners on whose property events take place,
B) Patrons and sponsors,
C) Agencies, emergency services and all other natural persons or corporate bodies, who are connected with the organization of the event,
D) Those agencies responsible for the construction and maintenance of the roads, insofar as damages are caused by the condition those streets, roadways and areas, including the equipment, are in that are used for the event, and
E) The vicarious agents of all the above-mentioned individuals and bodies
F) the other participants, the proprietors, the owners of the other vehicles, as well as against the members of your own team (other particular agreements amongst the members of your own team precede!)
Except for damages resulting in the injury to life, body or health, and which are based on an intentional or negligent breach of duty – including those of a legal representative or vicarious agent of the group of people not liable, and except for other damages which are based on an intentional or grossly negligent breach of duty – including those of a legal representative or vicarious agent of the group of people not liable.
The limitation of liability takes effect for all participants with the delivery of the registration or respectively this waiver of liability to the organizer.
The waiver of liability applies to all claims, irrespective of their legal foundation, in particular indemnity claims arising from contractual, as well as outside of contractual liability and for claims from tortious acts.
Implied disclaimers remain unaffected by the preceding exemption clause.
The organizer manages the course of the event in the regulations. Offroad Solutions Ltd. assumes no liability in those cases where the driver doesn’t accept the oranizer’s regulations and therefore doesn’t participate or the organizer denies the driver’s application.
It is imperative to check the appropriate boxes:
It is affirmed that the □ driver / □ co-driver is the owner of the entered vehicle
□ Driver or co-driver aren’t the owner of the entered vehicle.
The vehicle owner issues the following printed waiver (page 3). Is a statement not applicable, the contender/driver /co-driver exempts the group of people listed in the release from A-F from liability, of all claims by the vehicle owner, except if the damages were caused intentionally or grossly neglegently by these.
This declaration of exemption refers to damages which occur in connection with the event at large.
With my signature I confirm that I have taken note and accept the statement regarding the waiver of liability for the e-miglia 2012.

Waiver of the vehicle owner:
(Only required, if the driver or co-driver isn’t the owner of the entered vehicle)
I consent to the participation of the vehicle specified below in the e-miglia 2012 and agree to waive any sort of claims for damages which occur in connection with the event, namely against:
A) the organizer Offroad Solutions Ltd., the company Schalber Event GmbH, the company Rebel Media GmbH, the company Rebel Marketing GmbH, the company Rebel Productions GmbH, the company Good Guy Marketing GmbH, all of their officers, managers, and their employees, track guards and marshals, as well as property owners on whose property events take place,
B) patrons and sponsors,
C) agencies, emergency services and all other natural persons or corporate bodies, that are connected with the organization of the event,
D) the road construction load carrier insofar damages were caused by the condition of the streets, roadways and areas including the equipment which was used during the event, and
E) the vicarious agents of all the above-mentioned individuals and bodies,
F) the other participants, the proprietors, the owners of the other vehicles, as well as against the members of the team of the vehicle I provided (other particular agreements amongst the members of your own team precede!)
